Privacy Policy and consent to the use of personal data for www.graph.me

1. The scope and purpose of this statement and consent


1.1. www.graph.me and other domains (country domains etc.) is a website (hereinafter the "site") of Manui GmbH in Munich, registered at the local court of Munich [Amtsgericht München] under HRB 174847 (hereinafter "Manui" or the "operator"), phone: +49 (0) 89 - 545 704 67, fax: +49 (0) 89 - 545 704 68, email: info@graph.me, authorised representatives Andreas Reiter, René Kunkel, Sebastian Paschold, operated as an interactive online platform for conducting and participating in polls on the internet. The operator is the responsible agency within the meaning of the Data Protection Act [Datenschutzgesetz]. The following terms will provide information about what data is collected during your use of graph.me and how it is processed and used. This Privacy Policy supplements the terms and conditions of the operator for the use of the site.

1.2. The protection of your personal data is a central concern for the operator. Manui collects, processes and uses your personal data in compliance with the privacy laws of the Federal Republic of Germany and the privacy policy of the European Union. Via this Privacy Policy Manui wants to inform you, how your personal data will be used and processed by Manui and and how you can exchange data with other users of the site.

1.3. By using graph.me, you give your consent to the collection, processing, use and disclosure of your personal data by the operator in the scale shown below. You may withdraw your consent towards the operator at any time with future effect. You are cautioned that the performance of the operator is provided regardless of whether you express or revoke your consent. Since the communication platform is based within the group of users on a reciprocal provision of information, some profiles and information of other users can only be retrieved by users who provide their own profiles and information and have given their consent for processing use and disclosure of their own personal data.

2. The site

The site of the operator provides an interactive online platform as a social and interactive network on the internet. Registered users have the possibility to create polls, participate in these, and to evaluate them.

3. The data collected and purpose




3.1. Registration data


3.1.1. When registering each user must provide the following data:

3.1.2. The registration data must be provided for the application. The selected account name will not be approved unless it has not already been used by the time of application. The operator will not disclose your password and your email address to third parties and / or inform third parties about it. The registry data alone doesn‘t enable third parties to identify the identity of the user.

3.2. Inventory data


3.2.1. To use more (fee-based) services of graph.me, the operator collects and processes certain other personal information in the case of a request for establishment of such a wider user account or other fee-based services.. This involves following data:

3.2.2. The operator will generally not pass the inventory data to third parties for commercial purposes. The inventory data is disclosed only on the basis of an explicit order or in the context of the payment of fee-based services (processing via payment service provider, banks).

3.3. Interaction data


3.1. Other data - including the data entered by the user - is collected, linked, created, stored used and processed through the interactive use of the services on the website by the users themselves, other users and the operator. This involves currently in particular the following data:

3.4. Collected and processed data from unregistered users


3.4.1. The anonymized data, (i.e. the response of a non-registered user together with the recorded attributes of this user) are stored in each poll and, as constituted in this privacy policy, processed, and possibly passed to third parties (e.g. for market research). However, the answered polls and the corresponding attributes of a non-registered user are not linked with each other by the operator.

3.4.2. For unregistered users who select the option "Store votes and demographics to a cookie" when answering a poll, all recorded data is stored and linked. This means that the non-registered user does not have to enter attributes again that he has already entered once in other polls. Depending on the nature and extent of the data collected, the linkage of the data may generate personal information such as in the case of a registration. This data may be processed and possibly passed on to third parties as shown in paragraph 10.

3.4.3. Data from unregistered users that directly reveal their identity (see inventory data in paragraph 3.2.), are not passed on to third parties without their explicit consent.

4. Cookies and log files


4.1. Cookies


4.1.1. The operator uses cookies (HTTP cookies and Flash cookies) and collects, processes, and thus uses usage data from you. The use of these cookies is used to make the site user-friendly and user-related as well as effective and safe. For example, the data required for the authentification of your log in can be saved in order to enable a simplified login. In addition, cookies are used among other things for a personal greeting on the site and the provision of applications that are tailored to you personally.

5. Use of Google Analytics

You can also prevent the acquisition of the data generated by the cookie and
related to the usage of the website (including your IP address) as well as the processing of these data by Google, by installing the available browser plug-in which can be downloaded via the following link. Given the debate about the use of analytical tools with full IP addresses, we want to point out that this website uses Google Analytics with the extension "_anonymizeIp ()" so that IP addresses are processed only shortened to exclude a direct reference to individuals.

6. Social Plugins

6.1. Facebook / Facebook Connect

graph.me partly uses so-called social plugins ("plugins") of the social network "Facebook.com" (hereinafter called "Facebook") operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. You can identify these plugins by the Facebook logo or textual reference to Facebook or the label "Facebook Social Plugin".

When activating a graph.me page that contains such a plugin, a direct connection is built to the systems of Facebook via your browser. The activated content of the plugin is then transmitted directly from Facebook to your browser, from which it is incorporated into the website.

In addition, the plugin will inform Facebook that the particular page was activated on graph.me via your browser.

If you are simultaneously logged into Facebook on the same computer, Facebook can allocate and link the activation of a graph.me site to your Facebook account, though this is not limited to the pure activation. 6.2. Google +1

graph.me also uses the "+1" button of the social network, Google Plus, which is operated by Google Inc. 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google"). The button is indicated by the symbol "+1" on a white or colored background.

When you visit a page of our website which contains such a button, your browser is connected directly with Google's servers. The content of the "+1" button is directly sent from Google to your browser and incorporated into the website. We therefore have no influence on the amount of data that Google collects via the button, but we assume that your IP address is gathered.

If you are a Google Plus member and don‘t want Google to collect information about you via our website and link it with your member information stored at Google, you must log out of Google Plus before you visit our website.

7. Use of third party services

7.1. Disqus

graph.me uses the Disqus comment system. To leave a comment, the user must specify a username and an email address (which has not to be identical with the graph.me registration data). The data (comments, username, email) will be stored on Disqus servers. Disqus may set cookies.

8. Sharing information with authorities and links

8.1. The operator will disclose your registration, inventory and / or interaction data to investigating, law enforcement and regulatory authorities, if this is necessary to prevent threats to the state and public security and for the pursuit of crime or the enforcement of intellectual property.

8.2. The operator points out that you can get from the site to third party websites through links. These external websites have been examined for illegality and criminality by the operator when setting the links. However, a change of content in hindsight can not be excluded. The operator is not obliged to consider this constantly and takes over no liability for the privacy policies of those sites. For your own safety, please read their privacy policies carefully.

9. Newsletter

10. Declaration of consent of the user

10.1. 10.2. The User agrees that all personal data, that is collected by the operator in the context of the contractual relationship, is allowed to be stored on the servers of Manui GmbH, processed, and to be used for creating user profiles, the purpose of billing for the services, our own market research, demand-design of the website and for individual creation and sending of information and advertising of the operator. 10.3. The user agrees further that the following interaction data - even after the end of the contractual relationship - is processed, analyzed and used in anonymous form for purposes of market research, for commercial use and for creating and the dispatching of selected information by email and post by the operator and certain third parties, and that these data is stored, processed and used for this purpose by the provider and passed also to customers and cooperation partners of the operator:

10.3.1. Statistical data on (i) sex, (ii) birth, or age, (iii) country and postal code of residence, and other statistical data which do not allow assignment to individual people.

10.3.2. The interaction data, including information on the results of poll-participation, comments, motion paths and information about the usage on the site and personal characteristics notified by the user, each in a form that does not allow for direct assignment to individuals.

10.4. The User hereby agrees to the use of cookies and log files and the associated collection, storage, processing and use of personal data in accordance with the preceding paragraphs 4.1. and 4.2., in particular that information is transmitted via the internet browser of the user and stored by the operator for a period not exceeding six months in so-called log files (server log files) in case of a user-led access to the platform.

10.5. The User agrees to the disclosure of his personal data to authorities in accordance with the foregoing paragraph 8.1.

10.6. The user agrees that the operator uses the personal data and settings of the user to send information and reports as well as promotional emails and newsletters to his registered email address.

10.7. Regardless to clause 8.1, the inventory data of the user is not disclosed to third parties without explicit consent.

11. Effect and objection to the consent

11.1. By using graph.me you give your consent to the processing of your personal data in the form,as shown in this privacy policy .

11.2. You have the option to object your consent to the collection, storage, processing, linking, and disclosure of personal data in whole or in part at any time with effect for the future towards Manui. The objection shall be sent by email to recall@graph.me or by mail to Manui GmbH, Candid Platz 1, 81543 Munich.

11.3. You also have the option to object your consent for sending personalized advertising, newsletters and emails at any time in whole or in part with effect for the future, by sending an email via the link at the end of the respective newsletter to unsubscribe or by activating and adjusting the corresponding settings under the function „communication“ after logging in.

11.4. After termination of the contractual relationship the user's account and his inventory data will be locked. Upon termination of the contractual relationship or the receipt of the objection, the user's account and his inventory data are deleted within 30 days. If the user is invoiced for payment services or utilisation, the cancellation is made within 6 months after sending the invoice. If objections are raised within this period against the bill or if the request for payment is not made in spite of the invoice, the user's data will remain stored until the objection is resolved or the final payment claim is settled.

11.5. Non-registered users who have selected the function "Store votes and demographics to a cookie." (see paragraph 3.4.2) and withdraw their consent for the processing of personal data, will receive a link through which the cookie, that collects and links the data, is deleted. Similarly, the link between answered polls of a user will be deleted. The answers and associated features however remain stored in the respective survey.

11.6. Even after termination of the contractual relationship the interaction data are stored and processed by the operator in an anonymised form and without any linkage with registration and the inventory data, and processed for the operator‘s own commercial purposes and market research and also disclosed to partners and customers of the operator for these purposes.

12. Amendments to this Privacy Policy

Manui reserves the right to change this Privacy Policy at any time in accordance with applicable data protection regulations / laws.
